All the membership rules contained herein apply equally to members, non-members, and site visitors alike.

THE GYM

All reference to the ‘Centre’ refers to all St Austell Leisure facilities located at Tregorrick Leisure Centre, its staff, employees, sub-contractors, agents, and representatives. Facilities include the three gyms, showers, changing rooms, sports hall, squash court, sauna, grass areas when used for individual, group, or supervised fitness activities.

Members of the Centre are bound, as a condition of membership, to comply with the rules set out below. This is to ensure that the facilities are properly and safely used and that all members have full advantage of them without interfering with the enjoyment of others.

MEMBERSHIP

Memberships are Non-Transferable and Non-Refundable.

All members must be over 16 to avail of facilities and services provided at Tregorrick Leisure Centre. Users under the age of 16 cannot become members but may use specific areas of the facility subject to supervision, being a part of a structured event organised by the centre or an outside organisation, or subject to a proven induction of the equipment allowed by one of our qualified instructors.

Tregorrick Leisure Centre is a community leisure facility that caters for both members and non-members. We reserve the right to refuse membership and or access to any individual without cause. References may be required on a case by case basis.

Membership may be renewed on payment of the prevailing fee and in accordance with the terms and conditions then in force.

By joining the Centre, members automatically accept and agree to be bound by these conditions of membership.

St Austell Leisure Limited may withdraw use of all or part of the centre for the purpose of undertaking maintenance work or any other work considered necessary as long as sufficient notice of no less than one week is given, unless emergency action is required and the Centre requires immediate closure on the grounds of Health and Safety.

Entry will only be permitted to those with a valid membership or corresponding non-member fee being paid. If you have an amount due to be paid on your account, you will not be able to enter the training areas or make use of the showers or changing rooms.

As a member you agree to comply with the rules of the Centre with regards to use of the facilities, opening hours and your conduct. St Austell Leisure Limited may make reasonable changes to these rules, from time to time, provided we give advance notice of such changes.

You may, at your own discretion and expense, obtain personal insurance for loss, injury, or damage that you might sustain arising from use of the Centre. You exercise at your own discretion and accept any injury or illness brought on by exercise is your own responsibility.

Members and casual users wishing to report on accidents, incidents, or problems with services at the Centre should contact the Manager (simply ask at the reception desk) or can email Darren Thompson at staustellleisure@gmail.com in confidence.

In the event of a breach of membership rules and regulations St Austell Leisure Limited reserves the right of admission and may reserve the right to require any member or non-member to leave the premises. Any user found in breach of rules or committing an illegal act, including theft, will be asked to permanently leave the Centre and, subject to review and appeal, may be barred from ever entering the Centre again.

BANK CARD DIRECT DEBIT PAYMENTS

On selecting the Pay Monthly membership options, members will be required to pay the 1st-month pro-rata membership fee in advance. Members are required to agree to the normal terms and conditions of payment.

This is a recurring monthly charge by direct debit. Membership Fees will be debited from the member's account, using their given bank account details, on or around the 4th of each month, for the minimum 1-month term from the term start date.

Members are required to keep their account in funds to meet these payments. In the event of the failure to pay the monthly membership fee, missed payments will be re-submitted for payment by GoCardless. St Austell Leisure Limited reserves the right to cancel membership if payment is not received. Access to the facility will be denied until said payment is received.

Failure to pay direct debit fee: in the event of the failure to pay the monthly direct debit fee, you will first be notified that your membership has been temporarily stopped until the balance is paid.

OPENING HOURS

St Austell Leisure Limited reserves the right to vary the opening hours as considered necessary for the proper operation of the facility.

CHILDREN OR THOSE WITH GUARDIANS

Where children or those with guardians are enrolled in any of the activities offered by the centre, the guardian making the respective booking will be responsible for ensuring that the participant is in suitable physical and mental health to participate in the activities involved. St Austell Leisure Limited will not be liable for any incident or injury caused by any prior condition. Parents or guardians must notify St Austell Leisure Centre of any relevant issues prior to confirming a booking. The general conditions of site use herein apply equally to everyone participating in these activities.

GUESTS

Non-members are welcome to use the facilities and services of the centre, by purchasing a 1-day gym pass or one session activity fee. There is no limit to the number of day passes or activities that can be purchased.

SAFETY & HYGIENE

Throughout the course of your membership with the Centre, regular health and medical screening should be sought from your General Practitioner.

Before using the fitness facilities, you should go through a basic introductory session with one of the fitness staff, to ensure that you understand the equipment and adopt a safe training regime that suits your needs. The booking of this is your responsibility. Should you wish to waive this induction process you must sign a waiver form available during your enrolment process to indemnify St Austell Leisure Limited of any risk to yourself from that point forward.

It is necessary that all members and guests of the Centre wear appropriate, clean attire and footwear when using the facilities.

If you feel dizzy, faint, unwell or feel any unusual pain then you must stop exercising and inform a member of staff immediately.

In the interest of hygiene members must wipe down each piece of equipment after use with the hygiene products provided by the Centre.

DISCLAIMER OF LIABILITY FOR LEGAL DECLARATIONS

If any provisions of these terms and conditions are found to be illegal, outdated, less legally preferable in a legal action or otherwise unenforceable by reason of the laws of United Kingdom, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect. We refuse to accept liability for parties who do not make us openly aware of faults and later deny such observations in legal action.
